In New Jersey and across the U.S., more and more courts have begun requiring divorcing couples and others involved in family disputes to attempt mediation. There are many benefits to alternative dispute resolution methods such as meditation, because they can create a more open dialogue between the parties and create an atmosphere for amicable resolution of issues.
The Benefits of Family Law Mediation
Family law mediation, or economic mediation, is now at the forefront of the resolution of divorce and family law matters. Two of our attorneys have been qualified by the New Jersey Supreme Court as economic mediators. We facilitate divorce settlement agreements between couples who are representing themselves in divorce actions. We also mediate disputes in other areas of family law.
Family law mediation is different from traditional litigation for a variety of reasons, including:
- It is a more humane, less risky process that will avoid trial altogether if the parties are successful in reaching a settlement.
- The process gives the parties more control over the terms of their divorce settlement. The power to negotiate rests with the parties themselves, and there is more freedom to be creative with the terms of child support, child custody and visitation as well as alimony and marital property division.
- During the process, each side can bring in experts to help clarify the issues, such as business valuation, real estate appraisals and child welfare.
- Family law mediation is non-binding and confidential. What happens within the family law mediation process generally cannot be used as evidence or brought to the judge's attention during divorce litigation.
- Because there is buy-in from both parties, settlements negotiated in family law mediation are more likely to avoid unwanted modification through subsequent litigation or appeal.
- Family law mediation promotes judicial economy by freeing up the dockets and helps people resolve their differences without court intervention.
